Terms & Conditions of Voting For People’s Choice Award:
1. Promoter
The promoter is Tropfest Foundation Ltd (ABN 83 688 694 279), a not-for-profit organisation registered in Australia (“Promoter”).
The Tropfest People’s Choice Award is presented by CommBank. For the avoidance of doubt, CommBank is not the promoter, sponsor, administrator, or judge of this award, and has no responsibility for the conduct of voting, selection, or administration.
2. Application of these Terms and Conditions
These Terms and Conditions apply to participants (“Voters”) of the Tropfest People’s Choice Award (“Award”) voting process (“Vote”).
3. Acceptance of Terms
By participating in the Vote, Voters agree to be bound by these Terms & Conditions.
4. Eligibility to Vote
Voting is open to anyone, including employees, contractors, directors and immediate family members of the Promoter may vote, provided that they are not directly involved in the administration of the voting process.
5. Voting Period
Voting opens on 22nd February 2026 11:00pm AEDT and closes on 6th March 2026 9:00pm AEDT (“Voting Period”).
Votes received outside the Voting Period will not be counted.
6. How to Vote
To cast a valid vote, Voters must:
Watch the Tropfest 2026 finalist films.
Submit a vote via the official Tropfest voting form on tropfest.com
Provide required details as requested in the form.
Voters are permitted to cast one vote per person, unless otherwise stated.
The Promoter reserves the right to disqualify duplicate, automated, or fraudulent votes.
7. Determination of Winner
The Award winner will be determined solely by the highest number of valid votes received during the Voting Period.
The Promoter’s decision regarding the tally and outcome is final and no correspondence will be entered into.
8. Nature of the Award
The Award is an honorary recognition only.
No cash prize, goods, services, or other material benefit are associated with the Award.
The winning film will receive the title “Tropfest People’s Choice Award Winner” and may be promoted by Tropfest as such.
Voters will not receive any award or prize for their participation in the Vote.
9. Public Announcement
The winner of the Tropfest People’s Choice Award will be announced via Tropfest channels following the conclusion of the Voting Period. By voting, participants consent to Tropfest announcing the winning film publicly.
10. Liability & Indemnity
To the maximum extent permitted by law, the Promoter accepts no responsibility and excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any liability, loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising out of the Vote, including, without limitation:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference; or
any Vote that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
Nothing in these Terms limits any rights under Australian Consumer Law.
11. Privacy
Personal information collected will be handled in accordance with the Promoter’s Privacy Policy and the Privacy Act 1988 (Cth). Personal information of Voters may be used for the purpose of conducting the Vote and Award or for promotional and marketing purposes, unless the Voter opts out. This may involve disclosing the information to third parties, including local regulatory authorities and the Promoter’s agents or third-party service providers (‘Purpose’). Voters who do not opt out, consent to the use of their personal information for the purpose.
12. Platform Disclaimer
The Award and Vote are in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, YouTube, TikTok, or any other platform used to promote voting.
13. Force Majeure
If the Vote is affected by events beyond the Promoter’s reasonable control (including weather, safety issues, or government restrictions), the Promoter reserves the right to modify, suspend or cancel the Vote and Award.
14. Governing law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
