Tropfest Foundation Ltd (ABN 83 688 694 279) and its related bodies corporate (us, we, our) have developed this Privacy Policy in accordance with the Privacy Act 1988 (Cth) (Privacy Act).  This Privacy Policy governs how we collect, store, use and share your personal information. This Privacy Policy applies to information provided to us whether via this website (website) or any other means and explains how we will comply with the Australian Privacy Principles under the Privacy Act. 

Although we will comply with this Privacy Policy in respect of information provided to us by persons under the age of 18 years, those persons must obtain the consent of a parent or guardian prior to using the website and the parent or guardian will be responsible for appropriately supervising the person’s use of the website.

  1. What personal information do we collect?

When you contact us, use any of our services, enter a film into the Tropfest festival, or otherwise engage with us, the kinds of personal information we collect include:

  • your first name, surname, email address and postal code;

  • your age;

  • your gender;

  • your occupation;

  • where you are an employee, consultant or supplier of ours, bank account and payment details;

  • where you are a sponsor of ours, your bank account and payment card details;

  • when you access our website, details about your IP address, browser session data, search queries and/or browsing behaviour and use of our website (including through the use of internet cookies);

  • where you are an employee of ours or applying for a job with us, or as a volunteer, your professional history such as your previous positions and professional experience; and

  • any other information required by law or so we need so we can provide you with, or you can assist us with the provision of, our services.

We do not collect any sensitive information, which is subject to additional requirements under the Privacy Act, such as information about your:

  • race or ethnicity;

  • political opinions;

  • religious or philosophical beliefs;

  • trade union memberships (if any); or

  • health or any disabilities.

2. How we approach collecting personal information

If it is reasonable and practical to do so, we will collect personal information directly from you. This will include contact details and other information relevant to providing services to you. We may collect information when you call us, sign up to our email marketing list, send us an email or letter, visit our offices, or when you enter into an agreement with us.

We may also collect personal information from third parties such as your representatives or publicly available sources of information. We only collect information that is reasonably necessary to help us provide our services to you, for you to sponsor us, for you to volunteer with us or for you to be employed by us.   • where you are a producer, to consider your entry into the festival and to allow you to enter and to participate in the festival, including to contact and communicate with you regarding your film;

  • for analytics and market research including to operate, improve and enhance your use of the website and services;

  • to improve the website;

  • for marketing purposes if you have signed up to our marketing list;

  • to keep you informed of relevant upcoming events and our activities;

  • for internal record keeping, administrative, invoicing and billing purposes;

  • for analytics and market research;

  • if you have applied for employment with us, to consider your employment application;

  • if otherwise required or authorised by law and to comply with our legal obligations; and

  • to allow the functions and services offered on the website to be provided to you.

If someone other than you provides us with your personal information that we did not ask for and we determine that we could have collected this information from you, we will notify you, as soon as practicable. However, we will not notify you if to do so would be in breach of an obligation of confidence.  If we could not have collected this personal information, we will lawfully destroy or make that personal information anonymous.

We will not collect personal information unless the information is reasonably necessary for or directly related to one, or more of our functions or activities.  If we are unable to collect personal information we reasonably require, we may not be able to do business with you or the organisation with which you are connected.

In the event of a security incident involving unauthorised access, use or disclosure of personal information where a third party with whom we share personal information is involved, we will seek to work cooperatively with them to protect the personal information we have shared with them.

You can, at any time, opt out of receiving marketing material by contacting us. You agree and acknowledge that even if you opt out of receiving marketing material, we will still send you essential information that we are legally required to send you relating to the services we provide. Once you opt out of receiving marketing material from us, you agree and acknowledge that this removal from our distribution lists may take several business days after the date of you request to be removed.

5. Accuracy of your information

We take all reasonable steps to ensure that your personal information held by us is accurate, up-to-date, complete, relevant and not misleading.  If you believe that any of your personal information is not accurate, up-to-date, complete, relevant and not misleading, please contact us and we will take all reasonable steps to correct it within a reasonable time.

7. Disclosure of information overseas

We may share some of your personal information with some of our service providers overseas to fulfil the purposes set out in this Privacy Policy, for example to provide marketing communications to you.

If you have signed up to receive marketing communications from us, we will disclose your personal information to MailChimp, which is based in and provides its services from the United States of America, and accordingly your personal information will be disclosed to the United States of America.

In many cases the transfer will be necessary to provide our services.

8. Storage and security

We will use all reasonable endeavours to keep your personal information in a secure environment, however, this security cannot be guaranteed.  These security measures are designed to ensure your personal information is not subject to unauthorised access, loss or misuse.  If you reasonably believe that there has been unauthorised use or disclosure of your personal information please contact us (see below).

We will only store your personal information for as long as we need it for the reasons given in this privacy policy or to meet our legal and regulatory responsibilities. If we no longer need your personal information, we will take reasonable steps to destroy it or make it anonymous, in accordance with our document and information retention policy, unless we are required under Australian law or a court or tribunal order to retain it.

Unfortunately, data security can be breached. If this happens, we have in place procedures to quickly investigate the incident and see if your personal information has been leaked.  If necessary, we will tell anyone affected in line with the requirements of the mandatory data.

You can ask to see the personal information we hold about you. We will respond to your request within a reasonable period of time and, where it is reasonable and practical, we will give you access to the information in the format you requested, and as allowed by the Privacy Act.
